We would like to inform our business customers that an update has been made to section 12.4.1. Postal services and Transportation of parcels in SmartPosti’s general contract terms for business customer.
The updated terms clarify SmartPosti’s liability for loss or damage of shipments under the CMR Convention and specify the services for which a fixed maximum compensation applies.
What has changed?
Under the previous terms, liability was defined according to the CMR Convention, with a fixed maximum compensation of €500 applicable to SmartPosti parcel locker service, SmartCourier services, Parcel Connect, and Express Business Day Parcel shipments within the Baltic countries and Finland.
The updated terms broaden and clarify the list of services to which the fixed €500 maximum compensation applies.
Updated liability clause:
SmartPosti is liable for the loss or damage of a Shipment in accordance with the CMR Convention, up to 8.33 SDR per kilogram of the gross weight of the lost or damaged shipment, except in cases where the following services are used:
Express Parcel
Home Parcel
Postal Parcel SmartPosti
SmartCourier services
Parcel Connect Baltics (only in the Baltic States and Finland)
Express Business Day Parcel services
For these services, the liability is limited to €500 per Shipment.
